The Supreme Court has unanimously ruled that Northern Ireland’s Brexit deal is lawful as it threw out a claim by leading unionist politicians.
The legality of the Northern Ireland protocol was challenged by figures including the former first minister Arlene Foster, who argued that it breached the Acts of Union and the Northern Ireland Act and should never have been signed.
They argued that the legislation contradicted existing laws guaranteeing unfettered trade within the UK. However, the Supreme Court ruled that while article VI of the Acts of Union had been “modified” by the protocol, it was done with the express will of a sovereign parliament — and so was lawful.
